This Affiliate Agreement (the "Agreement") is entered into by and between Our Family B LLC, DBA Made2Homeschool ("we", "us" or "M2H"), and you ("you" or "Affiliate") for participation in the Made2Homeschool Affiliate Program (the "Program").
1
Description of Program
1.1
The Program allows Affiliates to earn commissions on all membership subscription transactions made by Made2Homeschool members who signed up through Affiliate's unique affiliate link or code.
1.2
Our affiliate site operating through Kajabi will provide you with a unique affiliate link or code to be used in all promotions of Made2Homeschool. We will track all referral transactions and payout commissions to you based on these referrals.
1.3
Affiliate referral tracking uses a 60-day cookie window. Referrals must complete their transaction within 60 days of clicking your affiliate link to be attributed to your account.
2
Commission
2.1
We will pay you a commission of 15% of the transaction value on successful transactions made by Made2Homeschool members referred through your unique affiliate link or code.
2.2
Commissions for ticket sales for M2H Events will be 30%.
2.3
Commissions will be paid out on a monthly basis, within 30 days of the completion of the month in which the transaction was made. Payments will be made via PayPal business. A minimum balance of $20 is required before commissions will be paid out.
2.4
If a referred customer requests a refund before commissions are paid out, the commission for that transaction will be deducted from your balance.

Community Access
3.1
We will provide free Premium Membership access to Made2Homeschool's community platform to affiliates.
3.2
After 3 months as an affiliate, this may be revisited and revoked if less than 5 active membership accounts are attributable to your affiliate links. We reserve the right to revoke this free access at any time and for any reason.
3.3
The determination of active referred membership accounts will be based solely on the records of Made2Homeschool.
4
Promotion
4.1
Affiliates are expected to promote Made2Homeschool at least 2 times each month in order to maintain active affiliate status and community access.
4.2
Affiliates may promote Made2Homeschool on any social media platform, provided they adhere to all legal requirements for disclosure of an affiliate relationship.
FTC Disclosure Requirement: The Federal Trade Commission requires clear and conspicuous disclosure of affiliate relationships. When promoting Made2Homeschool, you must disclose that you may earn a commission from purchases made through your links. Disclosures should be placed near your affiliate link and use clear language such as "affiliate link," "#ad," or "I may earn a commission."
4.3
Made2Homeschool, its members and affiliates should only be represented by affiliates in a positive and constructive way. Any violation of these terms may result in removal from the Program.
4.4
Affiliates must not make false or misleading statements about Made2Homeschool.

Values
5.1
We believe in creating a community of like-minded individuals who share a passion for homeschooling and express their views only with kindness and respect. We require all affiliates to represent our company and products consistent with these values, including the promotion of a positive and respectful online environment.
5.2
By agreeing to become an affiliate, you acknowledge and agree to abide by our values and to act in a manner that upholds these principles. Our core values can be found at

5.3
We reserve the right to terminate this agreement and remove any affiliate who fails to represent our company and products in accordance with our values.
6
Eligibility
6.1
To be eligible for the Program, Affiliates must be active content creators with a following of at least:
- 500 subscribers on YouTube, or
- 1,000 followers on Instagram, or
- 5,000 followers on TikTok
6.2
Bloggers will be assessed on a case-by-case basis, and their involvement will be at the sole discretion of M2H.
6.3
M2H may waive these eligibility requirements at its sole discretion.
7
Duration and Termination
7.1
This Agreement will be in effect until either party terminates it. Either party may terminate this Agreement at any time, with or without cause, by providing written notice.
7.2
Any commissions earned prior to termination will be paid out in accordance with the terms of this Agreement.
8
Legal Requirements
8.1
Affiliates are responsible for complying with all applicable laws and regulations in their promotion of Made2Homeschool, including but not limited to FTC guidelines regarding endorsements and testimonials.
8.2
This Agreement does not create an agency, partnership, or joint venture between the parties, and neither party has the authority to bind the other to any obligations or liabilities.
9
Modification
9.1
We may modify any of the terms and conditions in this Agreement at any time, in our sole discretion. Any modifications will be effective immediately upon posting on our website.
9.2
If any modification is unacceptable to you, your only recourse is to terminate this Agreement. Your continued participation in the Program following our posting of a modification will constitute binding acceptance of the change.
10
Use of Trademarks and Intellectual Property
10.1
The Affiliate shall not use the Made2Homeschool trademarks, logos, or intellectual property without prior written consent from M2H.
10.2
Written consent is only given herein for the purpose of promoting Made2Homeschool and not for self promotion or promotion of any other entity.
10.3
Said intellectual property may not be used to create new graphical elements for Made2Homeschool promotion without the aforementioned written consent from M2H.

Confidentiality
11.1
The Affiliate shall keep confidential and not disclose any proprietary or confidential information of Made2Homeschool, except as required by law or authorized in writing by M2H. The Affiliate shall use such information solely for the purpose of performing its obligations under this Agreement.
11.2
Confidential information includes any information that is not generally known to the public and is not readily available, including but not limited to trade secrets, customer lists, financial information, business plans, marketing strategies, any messages, text or copy generated within the Made2Homeschool community, any information shared by other users within the community, any information within the content library and any other information that is integral to the functioning of Made2Homeschool.

Indemnification
12.1
The Affiliate agrees to indemnify and hold harmless Made2Homeschool, its affiliates, officers, directors, employees, and agents, from and against any claims, damages, liabilities, costs, and expenses arising out of the Affiliate's use of the affiliate program, including any breach of this Agreement by the Affiliate.

Duty to Read
13.1
I accept that under this agreement, I have a duty to read the terms of participation laid out in this affiliate agreement, and have done so. Furthermore, I understand and accept that I am precluded from using lack of reading as a defense against all remedies contained herein.
14
Liability
14.1
The Affiliate shall indemnify and hold harmless Made2Homeschool from any and all damages, claims, or other expenses arising from the Affiliate's promotion of Made2Homeschool, including but not limited to any claims for false advertising, copyright infringement, or defamation.
14.2
Made2Homeschool shall not be liable to the Affiliate for any indirect, special, or consequential damages arising from the Affiliate's promotion of Made2Homeschool.
15
Dispute Resolution
15.1
Any disputes arising out of or relating to this Agreement shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
16
Entire Agreement
16.1
This Agreement constitutes the entire understanding between the parties and supersedes all prior negotiations, understandings, and agreements between the parties relating to the subject matter hereof.
17
Governing Law
17.1
This Agreement shall be governed and construed in accordance with the laws of the State of Florida in the United States of America, without giving effect to any conflicts of laws provisions.
17.2
In the event any legal action is brought for the enforcement of this Agreement or an alleged dispute over its terms, the prevailing party will be entitled to collect reasonable attorney's fees and court costs incurred in that action, in addition to any other relief that party may be entitled to.
17.3
The venue for any such proceeding shall exclusively be the Fifteenth Judicial Circuit, in and for Palm Beach County, Florida.
18
Counterparts
18.1
This Agreement may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute one and the same instrument.
